Welcome to SYU Jewelry. By accessing our website, using our services, or placing an order, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please refrain from using our website or services. These terms form a legally binding agreement between you, the customer, and SYU Jewelry.

1. Definitions

  • "SYU Jewelry," "we," "us," or "our": Refers to SYU Jewelry, a business based in Ottawa, Ontario, Canada.

  • "Customer," "you," or "your": Refers to any individual or entity placing an order or using our services.

  • "Custom Order": Refers to bespoke or made-to-order jewelry designed specifically for a customer.

  • "Ready-Made Item": Refers to pre-designed jewelry available for immediate purchase on our website.

  • "Service": Refers to the use of our website, online store, and any related tools or services provided by SYU Jewelry.

2. Use of This Website

  • This website is operated by SYU Jewelry. By visiting our site and/or purchasing products from us, you engage in our Service and agree to be bound by these Terms and Conditions, including additional policies referenced herein.

  • You represent that you are at least the age of majority in your province or territory of residence (18 years in Ontario) or that you have permission from a legal guardian to use our services.

  • You may not use our website or products for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction (including but not limited to copyright laws) while using our Service.

  • We reserve the right to refuse service to anyone for any reason at any time and to update or replace these Terms and Conditions by posting changes on our website. It is your responsibility to check this page periodically for updates.

3. Order Processing

  • Engraving Service: A complimentary engraving service is provided on all purchases at no additional cost.

  • Payment Requirement: Full payment is required at the time of purchase for both Custom Orders and Ready-Made Items. All products remain the property of SYU Jewelry until full payment is received.

  • Ordering Process for Ready-Made Items: Select your preferred item or variant on our website and proceed to checkout.

  • Ordering Process for Custom Orders: For custom designs, contact Nina, the owner of SYU Jewelry, to discuss design specifics and pricing. Once the design and quote are finalized, proceed to checkout via the designated "Custom Design" product page with the agreed-upon price.

  • Design Previews and Revisions: For Custom Orders, a 3D preview of the design will be provided. Up to 2 revisions are included at no additional cost. Any further revisions will incur a fee of 50 CAD per revision.

  • Production Timeline: Standard production time is 3-4 weeks from the date of design confirmation. For expedited production, please contact us to verify feasibility; additional fees may apply for rush orders.

  • Order Confirmation: All orders are confirmed via email once payment is processed. This confirmation serves as proof of the agreement on design, price, and estimated delivery.

  • Order Modifications: Orders cannot be modified, canceled, or altered once production has commenced.

  • Jewelry Appraisal: An accredited jewelry appraisal can be provided upon request for an additional fee of 100 CAD. This service requires an additional 7 business days to complete.

  • Material Specifications: Customers are responsible for verifying any material specifications (e.g., metal type, gemstone quality) during the consultation process for Custom Orders. SYU Jewelry is not liable for misunderstandings not documented in writing.

4. Pricing and Payment

  • Pricing Structure: Prices are determined based on the cost of materials (e.g., metals and gemstones), design complexity, and craftsmanship required. Quotes for Custom Orders are provided during consultation and are valid for 14 days unless otherwise stated. We reserve the right to change prices for Ready-Made Items at any time without notice.

  • Payment Methods: We accept payments via debit/credit cards. All transactions are processed securely through third-party gateways. Please review the terms and conditions of the chosen payment gateway, as they are responsible for transaction security.

  • Currency and Taxes: Prices are listed in Canadian Dollars (CAD). Applicable taxes, including the Harmonized Sales Tax (HST) at the rate of 13% for Ontario residents, are added at checkout as required by Canadian law. International customers are responsible for any foreign taxes, import duties, or customs fees incurred upon delivery.

  • Payment Issues: In the event of a declined payment or chargeback, SYU Jewelry reserves the right to suspend or cancel the order. Customers will be notified and given 48 hours to rectify the payment issue before cancellation.

5. Shipping and Delivery

  • Packaging: All items are carefully gift-wrapped and packaged to ensure safe delivery.

  • Shipping Method: We ship using reliable carriers such as Canada Post, FedEx, and EMS, depending on the production location and shipping destination of the product. All shipments are insured and include tracking.

  • Shipping Costs and Timelines: We offer free standard shipping on all orders. International delivery times vary depending on the production location, destination, and carrier, typically ranging from 7-10 business days.

  • Customs and Duties: International customers are solely responsible for any customs duties, import taxes, or related fees imposed by their country. SYU Jewelry is not responsible for delays caused by customs processing.

  • Delivery Confirmation: A tracking number will be provided via email once the order is shipped. Customers are responsible for monitoring delivery updates and ensuring someone is available to receive the package if signature confirmation is required.

  • Lost or Damaged Shipments: If a shipment is lost or damaged during transit, SYU Jewelry will work with the respective carrier (Canada Post, FedEx, or EMS) to file an insurance claim. Replacement or refund will be processed only after the claim is resolved, subject to the terms of the insurance policy.

6. Cancellations and Changes

  • Orders cannot be modified, canceled, or altered once production has begun. For Custom Orders, production begins upon final design confirmation and payment. For Ready-Made Items, production is considered started upon order placement.

  • If cancellation is requested prior to production, a full refund will be issued within 7 business days, provided no work has commenced.

  • We reserve the right to cancel any order if a product is out of stock or if there are errors in pricing or availability, with a full refund issued to the customer. We will notify you of equivalent replacement options if available.

7. Returns and Refunds

  • Custom Orders: Bespoke or made-to-order pieces are non-returnable and non-exchangeable due to their personalized nature. Please ensure all design details, measurements, and specifications are finalized before production begins.

  • Ready-Made Items: Returns for Ready-Made Items are accepted within 14 calendar days from the date of delivery. Items must be unused, in original packaging, and in the same condition as received. Buyers are responsible for return shipping costs and any loss in value if the item is not returned in its original condition.

  • Refund Process: Refunds for eligible returns will be processed within 7 business days of receiving the returned item, using the original payment method. Shipping costs are non-refundable.

  • Damaged or Defective Items: If a Ready-Made Item arrives damaged or defective, notify us within 48 hours of delivery with clear photographic or video evidence showing the damage or defect as received. We will arrange a replacement or refund at no additional cost, subject to verification. SYU Jewelry reserves the right to inspect returned items to confirm that the damage or defect is due to manufacturing or shipping issues and not the result of misuse, improper handling, or intentional damage after delivery. Items must be returned in the same condition as documented in the initial evidence; any signs of tampering or additional damage may void the claim. Damage caused by the buyer, whether accidental or intentional, is not eligible for refund or replacement. SYU Jewelry reserves the right to deny claims suspected of fraud and may refuse future service or pursue legal action in such cases.

8. Intellectual Property Rights

  • All designs, sketches, 3D previews, and final products created by SYU Jewelry are the exclusive intellectual property of SYU Jewelry, protected under Canadian copyright law. Customers are granted a limited, non-transferable license to use the purchased jewelry for personal, non-commercial purposes only.

  • Reproduction, distribution, modification, or commercialization of our designs, in whole or in part, is strictly prohibited without prior written consent from SYU Jewelry. Violation of these rights may result in legal action.

9. Warranty and Repairs

  • Warranty: SYU Jewelry offers a one-year limited warranty on all jewelry, covering manufacturing defects only. This warranty does not cover normal wear and tear, accidental damage, loss of gemstones due to improper handling, or damage resulting from misuse or neglect.

  • Repairs: For repairs within the warranty period, contact us with proof of purchase and a description of the issue. Repairs outside the warranty period or for non-covered damages are available at a reasonable fee, to be quoted upon assessment.

  • Shipping for Repairs: Customers are responsible for shipping costs to send items for repair. SYU Jewelry will cover return shipping for warranty repairs only.

  • Care Instructions: To maintain warranty validity, customers must follow provided care instructions (e.g., avoiding exposure to harsh chemicals, proper storage). Failure to adhere to care guidelines may void the warranty.

10. Accuracy, Errors, and Omissions

  • We strive to ensure that all information on our website, including product descriptions, pricing, promotions, shipping charges, and availability, is accurate. However, we are not responsible for any typographical errors, inaccuracies, or omissions. We reserve the right to correct such errors and update or cancel orders if information is inaccurate, even after an order is submitted, without prior notice.

  • The material on this site is for general information only and should not be relied upon as the sole basis for decisions.

11. Prohibited Uses

  • In addition to other restrictions in these Terms and Conditions, you are prohibited from using our website or content: (a) for unlawful purposes; (b) to solicit others to perform unlawful acts; (c) to violate international, federal, provincial, or municipal laws or regulations; (d) to infringe on our intellectual property rights or those of others; (e) to harass, abuse, defame, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload viruses or malicious code that could affect our Service or related websites; (h) to collect or track personal information of others; (i) to spam, phish, or interfere with security features of our Service. Violation of these prohibitions may result in immediate termination of your access to our Service.

12. User Comments, Feedback, and Submissions

  • If you send us submissions (e.g., contest entries, creative ideas, suggestions, or feedback) via any medium, you agree that we may, at our discretion, edit, copy, publish, distribute, or otherwise use such submissions without restriction. We are under no obligation to (1) maintain submissions in confidence; (2) pay compensation for submissions; or (3) respond to submissions.

  • We may monitor, edit, or remove content deemed unlawful, offensive, or in violation of third-party rights, though we are not obligated to do so. You are solely responsible for the accuracy and legality of your submissions and agree they will not violate any third-party rights or contain malicious content.

13. Third-Party Tools and Links

  • Our website may include access to third-party tools or links to external websites over which we have no control. Use of such tools or links is at your own risk, and we bear no liability for any damages or issues arising from their use. We do not endorse or assume responsibility for third-party content, products, or services. Please review third-party policies before engaging with their services.

14. Liability Limitations

  • SYU Jewelry shall not be liable for any delays, damages, or non-performance caused by circumstances beyond our reasonable control, including but not limited to third-party artisan or workshop delays, supplier issues, natural disasters, pandemics, labor strikes, or transportation disruptions.

  • Our total liability for any claim arising from an order or use of our Service, whether in contract, tort, or otherwise, is limited to the purchase price of the affected product.

  • SYU Jewelry is not responsible for allergic reactions or injuries caused by materials unless explicitly warned against by the customer during consultation (e.g., metal allergies). Customers must disclose any known sensitivities prior to ordering.

  • We provide our Service and products "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement, except as expressly stated. We do not guarantee that our Service will be uninterrupted, error-free, or free from viruses or harmful components.

15. Dispute Resolution

  • Initial Resolution: We strive to resolve disputes amicably through direct negotiation. Please contact us with any concerns, and we will respond within 5 business days.

  • Arbitration: If a resolution cannot be reached through negotiation, disputes shall be submitted to binding arbitration in Ottawa, Ontario, under the Arbitration Act, 1991 (Ontario). The arbitration process will be conducted in English, and the arbitrator’s decision shall be final and binding.

  • Costs: Each party shall bear its own costs related to arbitration unless otherwise determined by the arbitrator.

16. Privacy and Data Protection

  • SYU Jewelry is committed to protecting your personal information in compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA) of Canada and applicable Ontario privacy laws.

  • Data Collection: We collect personal information (e.g., name, email, address, payment details) solely for order processing, shipping, customer service, and relevant communications.

  • Data Usage and Sharing: We do not sell, rent, or disclose your information to third parties except as required for order fulfillment (e.g., sharing with shipping carriers for delivery) or as mandated by law.

  • Data Security: We implement reasonable security measures to protect your data. However, we cannot guarantee absolute security against unauthorized access or breaches.

  • Customer Rights: You have the right to access, correct, or request deletion of your personal data. For full details, refer to our Privacy Policy on our website or contact us.

17. Amendments

  • SYU Jewelry reserves the right to amend or update these Terms and Conditions at any time without prior notice to reflect changes in business practices, legal requirements, or operational needs.

  • Significant changes will be communicated via email (for customers with active orders) or through a prominent notice on our website at least 14 days before they take effect.

  • Continued use of our website or services after amendments signifies your acceptance of the revised terms. If you do not agree to the changes, you must discontinue using our services.

18. Governing Law and Jurisdiction

  • These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without reference to principles of conflict of laws.

  • Subject to the arbitration clause in Section 15, any legal action or proceeding arising under these terms shall be brought exclusively in the courts of Ontario, located in Ottawa, and the parties irrevocably submit to the jurisdiction of such courts.

19. Accessibility and Language

  • These Terms and Conditions are provided in English. If you require assistance or a translation, please contact us.

  • SYU Jewelry strives to ensure our website and communications are accessible in line with the Accessibility for Ontarians with Disabilities Act (AODA). If you encounter accessibility barriers, please let us know.

20. Force Majeure

  • SYU Jewelry shall not be liable for any failure or delay in performing obligations under these terms due to unforeseen events beyond our control, including but not limited to acts of God, war, terrorism, government regulations, new or amended legislation, embargoes, natural disasters, strikes, or disruptions in supply chains. In such cases, performance timelines will be extended as reasonably necessary.

21. Severability

  • If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect to the fullest extent permitted by law.

22. Entire Agreement

  • These Terms and Conditions, along with any order confirmations and our Privacy Policy, constitute the entire agreement between you and SYU Jewelry regarding your purchase and use of our products and services. They supersede all prior agreements, understandings, or representations, whether written or oral. The failure of SYU Jewelry to enforce any right or provision of these terms shall not constitute a waiver of such right or provision.
